Pasco v. Knoblauch No. 08-60242

http://www.ca5.uscourts.gov/opinions/pub/08/08-60242-CV0.wpd.pdf

2-1 decision.

The law is not "clearly established" that it is illegal for police officer to knock your car off the road, causing you to crash and die.  Suspect was fleeing at high speed, but there was no evidence that bystanders were in danger, nor was there any evidence that the suspect's car was struck by the officer to prevent it from endangering others.

However, this incident occurred in Mississippi.  It is probably a true statement that the law (any law) is not "clearly established" in that state.

A word to the wise:  get out of the state before dark !
