No breach of peace claim for mental anguish when care repossed with kids in it, but given back when repo company found out about kids in the car.

Chapa v. Traciers & Associates, Inc., 267 S.W.3d 386 (Tex.App. -- Houston [14rh Dist] 2008).  What about false imprisonment?  Surely this is a tort of some kind?  No duty to not haul off kids without permission?  What about endangering the kids and having CPS label the repo person a child abuser?
